PLEASE READ THIS CHILDREN’S PRIVACY POLICY CAREFULLY BEFORE ALLOWING YOUR CHILDREN TO USE ANY SERVICES OR PRODUCTS PROVIDED BY ChangeUp LLC (“ChangeUp”)The Children’s Online Privacy Protection Act (“COPPA”) requires us to inform parents and legal guardians about how we collect, use, and disclose personal information from children under the age of 13. It also requires that we obtain parental consent before we allow children under the age of 13 to use certain features of our products.

As used in this Children’s Privacy Policy, the following terms have the following meanings:

“Parent” includes legal guardians.

“Child” means a child that is under the age of 13.

“Personal Information” or “Profile Information” means individually identifiable information including personal information such as a username, first and last name, birthdate, phone number, email address, and other contact information when you register for an account or are added to a team roster using ChangeUp services. Depending on the service provided, additional information may be collected to create a player profile, including but not limited to, pitch tracking, pitch analytics, height, weight, photograph and/or video and other biographical or personal information, and information about your performance or information relating to your team, league, or organization.

“Organization” means the organization or team with whom you are affiliated and with respect to which you enter information into ChangeUp’s product or authorize the organization to enter your information into their account and ChangeUp’s product. The Organization has elected to use ChangeUp’s services and/or products to, inter alia, track pitching and player performance and offer services to members.

“Service” means the services offered by ChangeUp through its websites, applications, services and tools.

Scope of this Policy. This Policy describes how we collect, use and disclose personal information about children under 13 years old when their Parent or other authorized adult subscribes on their behalf to a ChangeUp service or product. This policy incorporates by reference the Privacy Policy and Terms of Use Policy for ChangeUp. Those policies can be viewed by using the links provided to the right.

BY USING OR ACCESSING OUR SERVICES OR PRODUCTS, OR BY PERMITTING YOUR CHILD TO USE OR ACCESS OUR SERVICES OR PRODUCTS, YOU ARE ACCEPTING THE PRACTICES DESCRIBED IN THIS POLICY.

About Us. ChangeUp provides services and products used by members, leagues, clubs, teams, coaches, leagues and administrators in tracking player activity and performance. We at ChangeUp are dedicated to safeguarding your privacy.

Depending on the ChangeUp Service or product, a Parent will have the option to do some, if not all, of the following:

  • Create an account that includes Personal and/or Profile Information
  • Register your child online for membership or authorize a coach or league official to do so
  • Receive certain notifications, email or text from other users of the service or product
  • Post photographs or videos of your child
  • Make credit card or ACH payments online
  • View balances in accounts
  • Print medical release, waivers and other forms as necessary
  • Other activities related to the tracking of pitching and player performance.

The ChangeUp services and products are available to children under the age of 13 only with parental consent. The ChangeUp services and products are intended for parents or adult use until a child reaches the age of 13. Certain services and products can be used by children under the age of 13 only with significant parental involvement, oversight and approval.

Children under the age of 13 are not allowed to use ChangeUp services or products without a parent’s permission. Children under the age of 13 also may not subscribe to, or create their own account with ChangeUp. Children may only have a child account that is established by, and with the permission of, a Parent.

Parental Consent. COPPA requires ChangeUp to use reasonable efforts to ensure that before we collect any personal information from a child, the child’s parent receives notice of and consents to our information practices. As a parent, you should know that through the ChangeUp services or products, children under the age of 13 may participate in activities that involve the collection or use of personal information. However, children may not participate in any such activities without a parent’s permission.

If your child is under age 13, ChangeUp must have “verifiable parental consent” before we collect and use your child’s personal information. We do this in two ways: 1) Through the parent’s registration and payment for their child’s participation in a sport or activity; be a member of a team or club using a ChangeUp service or product; or, subscribe to use one of the ChangeUp services or products; and, 2) by the parent’s acceptance of that team or club’s collection of data from players, including through use of a ChangeUp product or service.

Information We Collect and How We Collect It. The ChangeUp Privacy Policy and Terms of Use sets forth the information we collect for both Children and those who are over the age of 13. This information is collected in the same manner regardless of age but in the instance of a child under 13, only with the Parent’s consent.

A Parent has many tools to monitor and supervise the child’s activities. Parents should always closely monitor their children’s use of any online service, including ChangeUp’s services or products.

Tracking Activities Via ChangeUp’s Services or Products. ChangeUp assists coaches, administrators, players and others associated with sports teams to track individual players’ pitching activities and performance.

We may partner with third parties to provide content and/or to display targeted advertisements. We will not share your child’s personally identifiable information with these third parties. However, some of these third parties may use tracking technologies, such as cookies and Web beacons, in order to track user activity. We do not exercise control over or have access to these tracking technologies or the information practices of these parties, which are subject to the privacy policies of these third parties.

Parents may request information from us on the type of data being collected, view their child’s information, and, if they choose, prohibit us from making further use of their child’s information. For more information on how to do this, see the section below entitled “How To Review, Delete or Alter the Information Collected From Your Child.”

How To Review, Delete or Alter the Information Collected From Your Child. You can review your child’s personal information at any time by request to ChangeUp. You may remove access for your child OR delete your child’s account entirely. You can also have your child’s personal information deleted and refuse to permit further collection of such information by us.

If you wish to view, delete or modify the information we have collected about your child or delete your child’s account or profile, you may do this by emailing us at legal@change-up.io. However, please understand that, even after removal, member content may remain viewable in cached and archived pages or by others if a member has copied or stored such content.

Data Security. ChangeUp cares about the security of your information, and uses commercially reasonable physical, administrative, and technological safeguards to preserve the integrity and security of all information collected through the ChangeUp services or products. However, no security system is impenetrable and we cannot guarantee the security of our systems. In the event that any information under our control is compromised as a result of a breach of security, ChangeUp will take reasonable steps to investigate the situation and where appropriate, notify those individuals whose information may have been compromised and take other steps, in accordance with any applicable laws and regulations.

Changes to this Children’s Privacy Policy. ChangeUp reserves the right to amend this policy at any time. Please check this page periodically for changes. We will post a date of when this policy changes to alert users that a new policy is in place. If we intend to use or disclose your child’s personal information in a manner materially different from that stated at the time of collection, we will notify you via email and obtain your consent to such changes.
